Workplace Misconduct Investigation
A report of unwanted or transgressive behaviour in the workplace — intimidation, bullying, discrimination or sexual misconduct — has an enormous impact on those involved and on the entire organisation. An internal investigation rarely provides the objectivity and thoroughness that the situation demands. SAJ Recherche conducts independent investigations with respect for all parties involved, enabling you as an employer to make a well-considered and legally sound decision.
What we investigate
What do we investigate?
We conduct an independent investigation into the facts behind the report. This includes structured interviews with the complainant, the accused and witnesses, document analysis of correspondence and complaint files, pattern analysis for structural behaviour or prior warning signs, and assessment against your code of conduct and relevant regulations. The result is a factual report with clear conclusions.
When is this necessary?
Organisations engage us when there is a complaint about sexual misconduct, signs of bullying or intimidation, reports of discrimination, matters raised through a confidential adviser that require investigation, or when the internal complaints committee is insufficiently independent. Taking prompt action in cases of misconduct is a legal obligation under the Dutch Working Conditions Act.
How does the investigation work?
You discuss the report confidentially with us. We define the scope of the investigation.
We draw up a plan with a timeline, persons to be interviewed and methods.
Our investigators conduct interviews and document analysis. Hearing both sides is standard practice.
You receive an independent report with conclusions and recommendations, suitable for employment law measures.
